What is subtracted when the minimum support payment is calculated?

According to the Ministry of Land, Infrastructure and Transport's October 6 notice, the amount you have already recovered and the relevant support are subtracted from one third of the deposit. Not only auction distributions but also repayments of the deposit return claim and auction-gain and rent support amounts are reflected in the calculation.

If you calculate the support from the distribution that landed in your account alone, you can miss other deducted items. Sort out your own recovery history and support history separately, then confirm the calculation with the responsible agency.

When do you apply for the minimum support payment and the advance payment?

You apply for the minimum support payment after the auction gain is calculated if you asked for the damaged home to be purchased, and otherwise after the procedure to dispose of the damaged home is finished. The advance payment for unauthorized-contract cases such as trust fraud is a program you apply for before the LH purchase or the disposal of the home is finished. It can later be settled against additional amounts recovered.

The two differ in application stage and eligible cases. Just because an auction hasn't finished doesn't mean every victim qualifies for the advance payment.

Which agency do you go to, and what documents do you prepare?

Korea Land and Housing Corporation (LH) handles payment and settlement. The official guidance lists the victim determination decision, a copy of the lease, an abridged resident registration transcript, a certified copy of the property register, a distribution table or allocation statement, and documents related to repayment of the deposit return claim.

Start by checking whether you have been determined to be a victim and what stage the disposal of your home is at, then confirm with LH's implementation notice when those documents should be issued and how to file. As of October 10, the program has not yet taken effect, so don't treat it as already accepting applications.

What should you check after applying?

After you apply, keep three things in mind.

• Notice: LH tells you whether you will be paid and how much within 90 days of the application date. This can be extended once, by up to 30 days.
• Appeal: If you disagree with the decision, you can file an appeal within 30 days of the notice date.
• Return: If grounds for returning money arise after payment, such as additional recovery, you must report and return it.
